TITLE

Recommendation to authorize the Department of Development Services to process a refund in the amount of $19,477 to RVSA, LLC, for the property located at 6899 Cherry Avenue.  (District 9)

 

DISCUSSION

During Fiscal Year 2017, RVSA, LLC, paid building and electrical permit fees and surcharges totaling $24,279 for a project located at 6899 Cherry Avenue.  The applicant has withdrawn the proposed project due to their client’s operational needs and is eligible for a refund in the amount of $19,476.13. Consistent with Long Beach Municipal Code Section 18.06.200 and the Master Fees and Charges Schedule, the Department of Development Services will retain applicable administrative fees.  The applicant’s Construction and Demolition Recycling Deposit, not included in the above amount, will be returned in full, which does not require City Council approval.

 

In accordance with Long Beach Municipal Code Section 3.48.040 refunds exceeding $10,000 must be approved by the City Attorney and City Council.  Approval to process the refund is requested on behalf of the applicant.

 

This matter was reviewed by Assistant City Attorney Michael J. Mais on November 2, 2017 and by Budget Management Officer Rhutu Amin Gharib on November 7, 2017.

 

TIMING CONSIDERATIONS

City Council action on this item is requested on December 5, 2017, to expedite processing of the refund and return of deposit.

 

FISCAL IMPACT

The amount of $19,476.13 will be refunded to RVCA, LLC, for the property located at 6899 Cherry Avenue, from the Development Services Fund (EF 337) in the of Development Services (DV). There is no local job impact associated with this recommendation.

Approve recommendation.
