TITLE

DISCUSSION
The owner of the property at the southeast corner of Ocean Boulevard and Pine Avenue (the old Jergins Trust building site) is preparing to develop that vacant lot with a 23-story condominium building containing 155 residential units, 7500 square feet of ground level retail space and a 1 O,500-square foot spa. The approved plan for the adjacent portion of Pine Avenue calls for reducing the street from 100 feet wide to 86 feet wide and shifting the centerline of the block westerly. Five lanes of travel are to be maintained in the roadway, as well as 15-foot wide sidewalks on both sides. The area to be vacated is shown on the attached Exhibit A.
On May 11, 2004, the City Council adopted Resolution No. C-28371 declaring its intention to vacate the easterly 14 feet of Pine Avenue between Ocean Boulevard and Seaside Way and set June 15, 2004, as the date for the public hearing. Notices are required to be posted and advertised 14 days prior to the public hearing.
A copy of the May 11, 2004, City Council letter is attached as Exhibit B. Deputy City Attorney Lisa Pes kay Malmsten reviewed this matter on June 2, 2004.
TIMING CONSIDERATIONS
Due to an oversight, notice was not published in the legally required time frame. To allow time for the required publication, we recommend that this matter be continued to June 22, 2004.
FISCAL IMPACT
A vacation-processing fee of $1,000 was deposited to the General Fund (GP) in the Department of Public Works (PW).
SUGGESTED ACTION
Receive supporting documentation into the record, conclude the hearing, and adopt resolution.
