TITLE
Recommendation to declare ordinance amending the Long Beach Municipal Code by repealing Section 10.58.030 relating to pedestrian angle of crossing, read and adopted as read.  (Citywide)
 
DISCUSSION
Section 10.58.030 of the Long Beach Municipal Code provides that no pedestrian shall cross a roadway at any place, other than by a route at right angles to the curb, or by the shortest route to the opposite curb, except in a marked crosswalk, and except at intersections where pedestrian traffic is controlled by a scramble-system automatic signal.
 
California courts have ruled this type of street crossing regulation by municipalities to be unconstitutional on the grounds that pedestrian street crossing is an area of law occupied by the state.
