TITLE
Recommendation to authorize City Attorney to pay sum of $50,000 in full settlement of lawsuit entitled Dorian Brooks v. City of Long Beach, et al.
 
DISCUSSION
On June 19, 2012, Long Beach Police officers executed a search warrant at 301 Atlantic Avenue, Long Beach, California; a marijuana dispensary was operating at the location in violation of Long Beach Municipal Code section 5.89.
 
Plaintiff Dorian Brooks was a volunteer working at the dispensary.  Officers encountered Brooks during the search, and Brooks alleges that officers used excessive force when he was arrested.  The City and the officers deny that any excessive force was used.
 
After extensive negotiations, the parties reached a tentative settlement of the entire action for $50,000.00, inclusive of attorney's fees and costs.  The Economic Development and Finance Committee approved the proposed settlement on May 6, 2014.
