TITLE
Recommendation to authorize the Department of Planning and Building to process a refund in the amount of $252,874 to The Olson Company in accordance with Long Beach Municipal Code Section 3.48.040.
 
DISCUSSION
On September 30, 2005, The Olson Company paid for plan review services in the amount of $258,035 to develop the property located at 645 W. Broadway, project number 447954. They submitted their plans while in final negotiation with the Long Beach Redevelopment Agency on developing the West Gateway Redevelopment area. On February 7,2006, The Olson Company decided to withdraw their plans as submitted. Therefore, an approval to process a refund in the amount of $252,874 (fees paid less $5,161 administrative cost) is requested on behalf of The Olson Company.
 
The City of Long Beach Municipal Code Section 3.48.040 requires that refunds exceeding $5,000 be approved by the City Attorney and City Council.
 
This matter was reviewed by Assistant City Attorney Michael Mais on April 1 1,2006 and Budget Management Officer David Wodynski on April 6,2006.
 
TIMING CONSIDERATIONS
Action is requested at the May 2, 2006 City Council meeting, to expedite processing of the refund.
 
FISCAL IMPACT
The refund amount of $252,874 will be refunded from the trust account where the collected fees are held.
