TITLE
Recommendation to authorize City Manager to amend Contract No. 33359 with Avi-Con, Incorporated, dba CA Construction, for an additional $68,739 for change order-related expenditures associated with the improvement of the City’s Multi-Service Center, at 1301 and 1327 West 12th Street, and execute all documents necessary to complete the construction of the Multi-Service Center, for a revised contract amount not to exceed $1,437,239. (District 1)

DISCUSSION
On December 10, 2013, the City Council authorized the City Manager to execute a contract with Avi-Con, Incorporated, dba CA Construction (CA Construction), for an amount not to exceed $1,368,500, for the improvement of the City’s Multi-Service Center (MSC). Additional contract authority is needed to complete work associated with unforeseen conditions in the existing buildings.

During construction, it was discovered that the overall condition of the MSC is much worse than originally anticipated. In order to complete all remaining work, additional contract authority of $68,739 is needed to address unanticipated foundation voids under the floor slab, plumbing repairs, exterior window waterproofing, exterior door replacements, roof insulation repair and wall framing corrections. These unforeseen conditions must be addressed to ensure that the newly renovated facility will not be damaged in the future by floor slab, plumbing, waterproofing or wall framing failures.

This matter was reviewed by Deputy City Attorney Amy R. Webber on August 7, 2014 and by Budget Management Officer Victoria Bell on August 14, 2014.

TIMING CONSIDERATIONS
City Council action is requested on September 2, 2014 in order to complete all remaining work.

FISCAL IMPACT
The contract increase of $68,739, for a revised total not to exceed $1,437,239, is budgeted in the Capital Projects Fund (CP) in the Public Works Department (PW). Project funding is provided by a Los Angeles County grant earmarked for MSC modernization. Approval o...
