TITLE

Recommendation to authorize City Attorney to pay sum of $245,000, in full settlement of lawsuit entitled Crystal Whitsett v. City of Long Beach, et al., Los Angeles Superior Court Case No. BC724248.  

DISCUSSION

Plaintiff alleges she was injured on December 5, 2017, when a tree limb fell from a City-owned eucalyptus tree onto her vehicle. Following extensive negotiations, Plaintiff agreed to accept $245,000.00 - inclusive of attorneys’ fees and costs - as a full, global settlement of this case.  The settlement was discussed in closed session, and approved, by the Government, Personnel and Elections Oversight Committee (Attorney/Client) on June 21, 2022.

SUGGESTED ACTION

Approve recommendation.
