TITLE
Recommendation to determine that the granting of Facility/Pipeline Permit No. P-237-09 to Long Beach City College will not be contrary to the public interest; and authorize City Manager to issue said permit in accordance with Section 15.44.060, Permit-Issuance, of the Long Beach Municipal Code, for the installation of communications and fiber optic data conduits. (District 5)
DISCUSSION
Long Beach City College (LBCC) has filed an application for Facility/Pipeline Permit No. P237 -09, to install proprietary communications and fiber optic data conduits across Conant Street west of Clark Avenue. There will be four 4-inch conduits crossing the 80-foot rightof-way of Conant Street. The conduits will service new building facilities on the college campus. The location of the proposed conduits are shown on the attached vicinity map.
The Department of Public Works has reviewed the application and found the proposed conduits to be compatible with existing installations and not an obstacle to any street use or any known proposed developments. Traffic control requirements stipulated by Traffic Division of the Engineering Bureau will be made a part of the special conditions for the excavation permit. LBCC, because it is a governmental agency, is not required by the Long Beach Municipal Code to file a bond or public liability insurance for this permit.
I n conformance with the California Environmental Quality Act, a statutory exemption for this installation was filed with the County Clerk.
This matter was reviewed by Deputy City Attorney Linda Trang on August 31,2009 and by Budget and Performance Management Bureau Manager David Wodynski on August 28, 2009.
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
FISCAL IMPACT
LBCC will pay an estimated annual permit fee of $190, which will be deposited into the General Fund (GP) in the Department of Public Works (PW).
