TITLE
Recommendation to authorize a Public Walkways Occupancy Permit for sidewalk dining at NY's Upper Crust Pizza located at 5291 East Second Street. (District 3)
DISCUSSION
Diaman, Inc., the operator of NY'S Upper Crust Pizza, requested a permit to temporarily occupy part of the adjoining sidewalk at 5291 East Second Street with portable fixtures
for the purpose of sidewalk dining. The proposed permit area and a list of furnishings - and accessories to be placed in the permit area are shown on the attached Exhibit A. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public rights-of-way.
This permit request was reviewed and approved by the Long Beach Fire Department on February 24, 2005. The width of the sidewalk at this location is 13.5 feet and a minimum clearance of 5 feet will be maintained between the permit area and the bus bench and trash container adjacent to the restaurant.
