TITLE

Recommendation to authorize City Attorney to submit claim for death benefits for approval by the Workers' Compensation Appeals Board, and if so approved, authority to pay $250,000 in compliance with the Appeals Board Order for decedent, David Garcia.

DISCUSSION

David Garcia by and through his widow, Melissa Garcia on behalf of dependent child, Aydan Reese Garcia, has made a claim for death benefits allegedly caused by his employment with the City of Long Beach.  The Economic Development and Finance Committee on October 18, 2011, approved the submission to the Workers' Compensation Appeals Board of Compromise and Release (Dependency Claim) for death benefits by the City and David Garcia on behalf of his widow for his dependent child.

SUGGESTED ACTION

Approve recommendation.
