TITLE

Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit for sidewalk dining at The Spoon n Bistro restaurant located at 649 Long Beach Boulevard.  (District 1)

DISCUSSION

The new operator of The Spoon n Bistro restaurant located at 649 Long Beach Boulevard. requests a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining.  The proposed permit area and the list of furnishings and accessories to be placed in the permit area are shown on the attachment.  Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public right-of-way.  The width of the sidewalk at this location is 24 feet.  A minimum clearance along the sidewalk adjacent to the permit area will vary from 10 feet, between the street tree and curb, and 7.5 feet, between the barricade and curb.

This matter was reviewed by the Development Services Building and Safety Bureau on August 5, 2015, by Principal Deputy City Attorney Gary Anderson on October 13, 2015, and by Budget Management Officer Victoria Bell on October 21, 2015.

TIMING CONSIDERATIONS

City Council action on this matter is not time critical.

FISCAL IMPACT

A permit processing fee of $616 was deposited into the General Fund (GF) in the Public Works Department (PW), and a security deposit of $580 was collected to ensure sidewalk repairs upon permit termination.  Approval of this recommendation will provide continued support to the local economy.
