TITLE
Recommendation to refer to Hearing Officer appeal of business license denial by So. Cal. Imports Inc., 6831 Paramount Blvd. (District 9)
DISCUSSION
The Department of Financial Management denied the business license application of
So. Cal. Imports Inc., 6831 Paramount Blvd. (Attachment 1) at the recommendation of
the Planning and Building Department (Attachment 2). The business has outstanding
building code deficiencies. The business has appealed this decision in a letter dated
May 18,2005 (Attachment 3).
The Long Beach Municipal Code (LBMC) prescribes that the applicant can appeal the
denial of a business license application to the City Council within ten days of the denial.
In addition, the LBMC prescribes that the City Council, at its next regular meeting or
within ten days of the filing of the appeal, shall set the appeal hearing. This appeal was
delayed, since the same letter also requested an extension of the application process.
The extension request was reviewed and denied by the Planning and Building
Department because plans have not been submitted nor pennits pulled. Whenever it is
provided that a hearing shall be heard by the City Council, the City Council may, at its
discretion, either conduct the hearing itself or appoint a hearing officer to conduct the
hearing.
This matter was reviewed by Deputy City Attorney Cristyl Meyers on June 28,2005 and
Budget Management Officer David Wodynski on June 27,2005.
TIMING CONSIDERATIONS
LBMC requires that the hearing be set at its next regular meeting or within ten days of
receiving the appeal.
FISCAL IMPACT
There is no fiscal impact associated with this item.
