TITLE
Recommendation to authorize City Manager to execute an easement deed to be granted to the Los Angeles County Flood Control District (LACFCD) for storm drain purposes. (District 3)
DISCUSSION
On September 4, 2001, City Council authorized the execution of a Cooperative Agreement between the City of Long Beach and Los Angeles County to provide for the construction of the Termino Avenue storm drain. The agreement authorized construction of the storm drain facility within public right-of-way property, however, major portions of the drain are being constructed on City property, which is not dedicated public right-of-way (primarily, the former Pacific Electric railway property). The attachment shows the locations of the easements requested.
Engineering plans for this project were prepared by Los Angeles County and reviewed by the City of Long Beach Department of Public Works. The installation of the storm drain facility is currently underway. In conformance with the California Environmental Quality Act, an Environmental Impact Report (State Clearinghouse No. 2000111022) was issued for this project.
This matter was reviewed by Deputy City Attorney Linda Trang on June 21, 2010, and Budget Management Officer Victoria Bell on June 30, 2010.

City Council action on this matter is not time sensitive.
FISCAL IMPACT
There are no fiscal or local job impacts related to the granting of this easement.
