TITLE

DISCUSSION
On April 15, 2008, the City Council authorized the City Manager to execute a contract with Palp, Inc., dba Excel Paving Company, in an amount of $1,213,347. During the process of removing the failed asphalt, an old pavement fabric was discovered in the underlying material. In order to assure that the new asphalt would adhere properly, this fabric material had to be completely removed, requiring the contractor to grind away an additional layer of asphalt. A first amendment to their contract in the amount of $500,000, is needed to compensate the contractor for this additional unanticipated work.
 
This matter was reviewed by Deputy City Attorney Linda Trang on July 31, 2008 and by Budget Management Officer Victoria Bellon August 1, 2008.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on August 19, 2008, so that outstanding invoices related to this contract can be processed in a timely manner.
 
FISCAL IMPACT
The recommended amendment to the Palp, Inc., dba Excel Paving Company, contract will increase it by $500,000, for a total contract amount of $1 ,713,347, plus a 15 percent contingency amount of $257,002, if necessary. Sufficient funds to cover the contract are budgeted in the Transportation Fund (SR 182) in the Department of Public Works (PW). The funding source is Proposition C.
