TITLE
Recommendation to authorize City Manager to execute the First Amendment to Contract No. 29456 with August Construction, Inc., for the Improvement of Naples Island Soil Anchors, Phase V, in an amount not to exceed $461,857, for a total contract amount of $1,094,086, plus a 25 percent contingency amount of $273,522, if necessary; and

Increase appropriations in the Tidelands Capital Fund (TF) and the Department of Public Works (PW) by $577,321. (District 3)

DISCUSSION
On November 1, 2005, the City Council authorized the City Manager to execute a contract with August Construction, Inc., in an amount not to exceed $632,229. Due to an increase in the amount of Tidelands funds available, staff recommends an increase in current appropriations to install additional soil anchors at various locations (see attached vicinity map). The contractor, August Construction, Inc., is willing and ready to perform the necessary additional soil anchor installations.

A first amendment to Contract No. 29456 with August Construction, Inc., in the amount of $461,857, is needed to perform the additional soil anchor installations. These soil anchors will replace the existing tie-rods and stabilize the adjoining property. This project has been coordinated with the Naples Island Association.

The original Council approval included a contingency of up to 25 percent above the award amount. With the new contract amount of $1,094,086, the new contingency amount is $273,522, if needed.

This matter was reviewed by Senior Deputy City Attorney Donna F. Gwin on February 16,2006, and Budget Management Officer David Wodynski on March 1 , 2006.


TIMING CONSIDERATIONS
City Council action on this matter is requested on March 14, 2006, to ensure that there are no construction delays.
