TITLE
Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit for sidewalk dining at the Congregation Ale House located at 201 East Broadway. (District 2)
DISCUSSION
The developer of a new restaurant to be known as the Congregation Ale House, located at 201 East Broadway, requests a permit to temporarily occupy an adjoining portion of The Promenade for the purpose of sidewalk dining, with a fixed sun-screen awning. The fixed sunscreen awning is requested as an accommodation to help mitigate the large expanse of window wall on the westerly façade of this historic building (modification of the façade wall is not an option). The proposed permit area and a list of furnishings and accessories to be placed in the permit area are shown on the attachment. The columns supporting the sunscreen awning are to be placed immediately outside of the paved permit area. Planning Department permit conditions as to the awning material, column size and finish, and railing design are to be included as a part of this permit.
Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public rights-of-way. The Promenade has a total width of 80 feet at this location. A central walkway and clear emergency access path of greater than 20 feet will be maintained beyond the permit area.
This matter was reviewed by Deputy City Attorney Linda Trang on August 10, 2010 and Budget Management Officer Victoria Bell on August 9, 2010. The Long Beach Fire Department's review and approval of this request shall be obtained prior to permit issuance.
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
FISCAL IMPACT
A permit processing fee of $1,249 was deposited into the General Fund (GP) in the Department of Public Works (PW). Approval of this permit may have a positive impact on local jobs.
