TITLE
Recommendation to authorize City Manager to execute any and all documents necessary for a license agreement between the City of Long Beach and Los Cerritos Wetlands Authority (LCWA), a California joint powers authority, for use of City-owned land located at the corner of 2nd Street and Shopkeeper Road, to allow access to LCWA-owned property and to conduct necessary environmental studies, including periodic bird counts. (District 3)
DISCUSSION
The LCWA owns property immediately adjacent to 33.77 acres of City-owned land located at 2nd Street and Shopkeeper Road that currently lacks access to any public street. As a result, LCWA has requested a license agreement to utilize an access road on the City’s land that will allow LCWA staff and contractors to access their property. The access road is currently used by City staff and authorized oil operators. In addition, the LCWA will also conduct environmental studies including periodic bird counts on the City-owned property.
In order to accommodate the proposed use, staff recommends a license agreement with the following major terms and provisions:
· Licensor: City of Long Beach.
· Licensee: Los Cerritos Wetlands Authority, a Joint Powers Authority between the City of Long Beach, Lower San Gabriel and Los Angeles River and Mountains Conservancy, California State Coastal Conservancy, and the City of Seal Beach.
· Access Area: Access Road on 33.77 acres of City-owned land as depicted in the site map (attached).
· Term: The term shall commence upon City Council approval and shall terminate on June 6, 2015.
· Right to Cancel: Both parties shall have the right to terminate the license agreement upon thirty days written notice.
· Permitted Use: Licensee shall, at its own cost, use the Access Area for the purpose of accessing LCWA-owned property and conducting occasional environmental studies under consultation with City staff.
