TITLE
Recommendation to authorize issuance of a public walkways occupancy permit for sidewalk dining at the Sevilla Restaurant located at 140 Pine Avenue. (District 2)
DISCUSSION
Cafe Sevilla of Long Beach is developing a new restaurant at 140 Pine Avenue to be known as Sevilla. They request permission to occupy part of the public sidewalk adjoining the restaurant for the purpose of sidewalk dining. The proposed permit area and a list of furnishings and accessories to be placed in the permit area are shown on the attached Exhibit A.
The width of the sidewalk at this location is 22 feet. A minumum clearance of 7 feet shall be maintained on the sidewalk between the permit areas and the curbline, which is consistent with the adjacent restaurant's occupancy. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code which describes temporary uses of public right-of-way.
Cafe Sevolla also requests permission to install conduit under the sidewalk to run power and a telephone line to a waiter stateion near the patio entrance. Plans approved by the Department of Planning and Building show the weather-proof receptacle mounted on a decorative barrier 20 inches above the sidewalk, adjacent to the waiter station. The location of the conduit is shown of pages 4 or 5 of 3 Exhibit A. This is the first time City Council being requested to consider this type of installation.
This permit request was reviewed and approved by the Long Beach Fire Department on August 30, 2005. The subject permit was prepared by Deputy City Attorney Lis Peskay Malmsten on October 19, 2005.
TIMING CONSIDERATIONS
City Council action on this matter is requested on November 1, 2005, in order to coordinate permit approval with the proposed restaurant opening.
FISCAL IMPACT
A permit processing fee of $1,200 was deposited to the General Fund (GP) in the Department of Public Works (PW).
