DISCUSSION
Section 16.08.740 of the Long Beach Municipal Code specifies that no piers or floating docks may be built beyond the pierhead line shown on City Engineer's Drawing No. E-146, titled "Harbor Lines Alamitos Bay." Docks may be constructed between the bulkhead and pierhead lines, in the space known as the pierhead allowance. However, while the existing dock structures between 5488 and 5538 East The Toledo were built with permits according to approved plans prior to 1991, they project beyond the pierhead line, as described below. It is proposed that the pierhead line be straightened in order to (i) add an area that is unnecessarily excepted from the pierhead allowance, and (ii) bring numerous existing and permitted docks into compliance with the Long Beach Municipal Code.

The Department of Public Works supports this action based on the following facts:

1. The pierhead line between survey control points 148 and 151 curves in a northerly direction toward the island, instead of following a straight line between the two points, as shown in the attached Exhibit A. This creates an exception or concavity in the pierhead allowance, which is not necessary for safety or navigational purposes.

2. On August 2, 2006, the California Coastal Commission (CCC) and the Army Corps of Engineers (ACE) were notified of the proposed pierhead line adjustment. The CCC and ACE did not raise any objections to this proposed adjustment.

3. The interested City Departments reviewed the proposed pierhead line adjustment and had no objections to this action.
