TITLE
Recommendation to authorize City Manager to execute a first amendment to Lease No. 28222 to authorize the Lessee's name change from Cathy Jacobson Guzy, an individual dba First Serve, to First Serve Tennis, Inc.; and authorize City Manager to execute future amendments.  (Districts 3,5)
 
DISCUSSION
For more than a decade, Cathy Jacobson Guzy, doing business as First Serve, (Lessee) has operated the Billie Jean King and EI Dorado Tennis Centers. The current lease with First Serve, Lease No. 28222 (Lease), expires December 31, 2013. Since the execution of the Lease, the Lessee's name has been changed to First Serve Tennis, Inc. The Department of Parks, Recreation and Marine verified the name change through the California Secretary of State and has received a copy of the recorded documents.
 
City Council authorization is requested to execute a first amendment to Lease No.
28222 to document the Lessee's new name and to authorize the City Manager to execute future amendments. All other Lease terms and conditions remain unchanged.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson on July 3, 2007, and Budget and Performance Management Bureau Manager David Wodynski on July 9, 2007.
 
TIMING CONSIDERATIONS
 
City Council action is requested on July 24, 2007, to enable the execution of the first amendment to document Lessee's name change.
 
FISCAL IMPACT
There is no fiscal impact associated with the requested action.
