TITLE
Recommendation to refer to Hearing Officer the business license revocation appeal for Guadalupe Perez, dba The Brite Spot Coffee Shop, 412 W. Pacific Coast Highway. (District 1)
DISCUSSION
On December 2, 2008, the Long Beach Chief of Police recommended that the Department of Financial Management revoke business license number BU05063360 issued to Mr. Guadalupe Perez, dba The Brite Spot Coffee Shop, 412 W. Pacific Coast Highway (Attachment A). The business has violated the Long Beach Municipal Code (LBMC), State law, conditions of its business license, and the Department of Alcoholic Beverage Control recently revoked the ABC license.
Pursuant to the LBMC, a licensee may initially appeal a business license revocation to the Director of Financial Management. Subsequent appeals are made to the City Council. On February 3, 2009, the business owner/operator waived his initial business license appeal to the Department of Financial Management (Attachment B). Whenever it is provided that a hearing shall be conducted by the City Council, the City Council may, in its discretion, refer the matter to a hearing officer.
Deputy City Attorney Cristyl Meyers reviewed this matter on February 4, 2009.
TIMING CONSIDERATIONS
If referred, upon selection of a hearing officer, the matter will be heard on a date to be determined in March 2009.
FISCAL IMPACT
There is no fiscal impact associated with this item.
