TITLE
Recommendation to authorize City Manager to execute an Assignment Consent Agreement for Facility/Pipeline Permit No. P-166-90 from Breitburn Energy Company L.P. to Breitburn Operating L.P., in accordance with Section 15.44.220, Permit-Transfer, of the City of Long Beach Municipal Code. (District 3)
DISCUSSION
Breitburn Energy Company L. P., is requesting consent to assign its interest in Facility/Pipeline Permit No. P-166-90 to Breitburn Operating L.P. This assignment will include 3,055 feet of a crude oil pipeline. The route of the pipeline in City property is shown on the attached vicinity map.
Since this is only a transfer of ownership with no use modifications, there will be no street excavation required as a result of this action. Liability insurance and bonding for faithful performance, as required by Section 15.44.220, Permit-Transfer, of the Long Beach Municipal Code, will be processed following City Council authorization of the consent for assignment.
This matter was reviewed by Deputy City Attorney Lori A. Conway on March 29, 2007.
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
FISCAL IMPACT
An estimated annual permit fee of $1,816 for the pipeline will be deposited to the General Fund (GP) in the Department of Public Works (PW).
