TITLE

DISCUSSION
On November 17, 2010, the Department of Parks, Recreation and Marine (PRM) received a proposal from East Long Beach Pony Baseball (ELB Pony) to furnish, install, and maintain a new batting cage and baseball netting at Heartwell Park, Area 3, Baseball Field Number 6 (Attachment A). The batting cage will be built atop an area that is currently being used as a pitching area/bullpen. The batting cage will be approximately 10' x 5' x 10', with a concrete base, and surrounded by baseball netting and a roof.

ELB Pony will donate and construct the batting cage in its entirety at no cost to the City of Long Beach (City). Upon its installation, the batting cage will become the property of the City and will be available for use by all permitted Heartwell Park baseball field users. On January 20, 2011, the Parks and Recreation Commission approved the proposed improvement and recommended that the City Council approve a right-of-entry permit and accept the non-monetary donation of planning, labor, and materials, equivalent to approximately $12,000 (Attachment B).

This approval shall be considered consent by the City in its capacity as property owner and not in its capacity as a regulatory agency. ELB Pony will still be responsible for obtaining all applicable building and construction permits, as required by law.
