TITLE

Recommendation to authorize City Manager, or designee, to execute a quitclaim to MZ Traffic Circle, L.P. and CK Traffic Circle, L.P., to convey the City’s interest in the current utility line easement at 4401 East Pacific Coast Highway, on the east side of the Los Alamitos Traffic Circle.  (District 4)

 

DISCUSSION

On August 21, 1969, the City of Long Beach vacated a portion of right-of-way at 4401 East Pacific Coast Highway and reserved easements for conduits, cables and wires, and incidental purposes (Exhibit A).  Since that time, the utility lines have been abandoned or removed and are no longer needed.  The owners of 4401 East Pacific Coast Highway, Curtis P. Cowan and Ralph E. Taylor, hired KZ Companies, LLC (Developer), to develop the project site and is requesting a quitclaim of the subject easement.

 

The customary investigation was conducted involving public utilities and interested City departments, and there were no objections to the proposed easements to be quitclaimed.

 

This matter was reviewed by Deputy City Attorney Linda T. Vu on April 20, 2017 and by Budget Analysis Officer Julissa José-Murray on April 19, 2017.

 

TIMING CONSIDERATIONS

City Council action on this matter is not time critical.

 

FISCAL IMPACT

A quitclaim processing fee of $2,846 was paid by the Developer and deposited in the General Fund (GF) in the Public Works Department (PW). There is no local job impact associated with this recommendation.

 

SUGGESTED ACTION

Approve recommendation.
