DISCUSSION
TS on the Shore Inc., the owner of Taco Surf located at 5316 1/2 East Second Street, requests a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining. The proposed permit area and a list of furnishings and accessories to be placed in the permit area are shown on the attachments. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code which describes temporary uses of public right-of-way. The width of the sidewalk is 13 1/2 feet. The minimum width of five feet will be maintained between the sidewalk dining area and other obstructions. If approved, the use of the permit area will be restricted to the hours between 10:00 a.m. and 10:00 p.m.

The restaurant has an existing patio on private property that is approximately three inches higher than the adjacent public sidewalk. The permittee plans to construct a raised patio surface within the public sidewalk on the existing pavers in order to have both dining areas at the same elevation. Precautions will be taken to prevent damage to the brickwork, and a higher than usual security deposit has been secured to return the public walkway to its original condition.

This permit request was reviewed and approved by the Long Beach Fire Department on January 9, 2014. This matter was reviewed by Deputy City Attorney Linda Vu on February 13, 2014 and by Budget Management Officer Victoria Bell on April 29, 2014.

TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
