TITLE
Recommendation to accept grant funding in the amount of $3,823,868 from the State Water Resources Control Board (SWRCB), increase appropriations in the Capital Projects Fund (CP) in the Department of Public Works (PW) by $3,823,868; and authorize City Manager to execute a Proposition 40 Grant Agreement and any amendments thereto with the State of California for remediation of the Colorado Lagoon. (District 3)

DISCUSSION
On June 23, 2005, the Department of Public Works submitted a grant application to the State Water Resources Control Board for funding from the Clean Beaches Initiative Program to significantly reduce bacteria contamination in the Colorado Lagoon (Lagoon). On December 23, 2005, the City was notified that it has been approved to receive grant funding in the total amount of $3,823,868 for remediation of the Lagoon.

The expenditure of this grant funding is limited to the construction of four low-flow diversions to the sanitary sewer system, construction of several bioswales and modification of the culvert leading to Marine Stadium. These projects will significantly improve the tidal circulation within the Lagoon .and prevent bacteria-laden, low-flow storm water from entering the Lagoon through the City's storm drain system, which ultimately flows onto Lagoon beaches.

This matter was reviewed by Deputy City Attorney Lisa P. Malmsten on January 18, 2006, and Budget Management Officer David Wodynski on January 25, 2006.

TIMING CONSIDERATIONS
City Council action on this matter is requested on February 7, 2006, in order to accept this grant.

FISCAL IMPACT
Total project funding is estimated to not exceed $3,823,868. This grant does not require the City to supply matching funds; therefore, no General Fund monies will be used to accept the grant. An appropriation increase to expend these new grant funds is included in the recommendation.
