TITLE
Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit for sidewalk dining at Roe Seafood Restaurant, located at 5374 East Second Street. (District 3)

DISCUSSION
The operator of Roe Seafood Restaurant, located at 5374 East Second Street, requests a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining. The proposed permit area and the list of furnishings to be placed in the permit area are shown on the attachment. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public right-of-way.

The width of the sidewalk at this location is 13 feet, 6 inches. A minimum clearance along the sidewalk adjacent to the permit area will vary from 9 feet between the barricade and curb, and 7 feet between the trash receptacle and barricade. Use of the sidewalk as a dining area is restricted to the hours between 10:00 a.m. and 10:00 p.m.

The Coastal Development Permit allowing sidewalk dining on Second Street provides for a Public Walkways Occupancy Permit for businesses on Second Street from Livingston Drive to Santa Ana Avenue. The requested sidewalk dining location is outside the Coastal Development Permit area; however, a separate Coastal Permit has been approved from the Planning Commission’s Notice of Final Local Action, application number 1212-03.

This matter was reviewed by the Department of Development Services Building and Safety Bureau on January 20, 2016, by Deputy City Attorney Robin Zur Schmiede on June 8, 2016, and by Revenue Management Officer Julissa José-Murray on June 13, 2016.

TIMING CONSIDERATIONS
City Council action is requested on July 5, 2016, so that the sidewalk dining permit area can open in time for the summer tourist season.
