DISCUSSION
The owner of the At Last Café, located on the corner of Orange Avenue and Second Street, requests a permit to temporarily occupy a part of the adjoining sidewalk for the purpose of sidewalk dining. This request proposes to install and maintain landscaping within the bulb-out rain garden recently constructed by the City adjacent to the restaurant and to occupy, for dining purposes, an area of recently reconfigured sidewalk that extends within the Orange Avenue roadway. The sidewalk reconfiguration plans and designs were reviewed and approved by the City Engineer and Traffic Engineer prior to construction, and consisted of improvements for public use, including intersection safety enhancements, by providing protection for vehicles parked in the angled parking stalls north of the intersection and providing a shorter east/west pedestrian crossing at the intersection. Additionally, the added sidewalk will provide a clearer and less obstructed pedestrian walking path to and from the northeast corner of the intersection.

A second permit area is proposed at the curbside along Second Street, adjacent to an area of recently striped angled parking for bicycles and motorcycles. This proposal was also reviewed and approved by the City Traffic Engineer. A sketch showing the proposed permit areas and a list of furnishings and accessories to be placed in the permit areas are shown on the attachment. If the permit is approved, the business owner, as well as the property owner, will be required to execute an Installation and Maintenance Agreement for the maintenance of the rain garden.

Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public rights-of-way. The sidewalk width at this locat...
