TITLE
Recommendation to authorize City Manager to execute all necessary documents to enter into a Memorandum of Understanding with the Los Angeles Superior Court for Data and Document Exchange.  (Citywide)
 
DISCUSSION
The Los Angeles Superior Court (LASC) provides criminal court records to local law enforcement agency employees under Penal Code section 13300.  Local law enforcement agencies that enter into a Memorandum of Understanding (MOU) with LASC are eligible to access these records electronically through the Data and Documentation Exchange Services (DDES) at no charge.  LASC has prepared a MOU to ensure that information accessed through the DDES remains confidential, and that information is used only for official business.
Staff is requesting City Council approval to enter into an MOU with LASC so that eligible law enforcement personnel at the Long Beach Police Department (PD) are able to access local criminal history information to support the investigative process.  PD agrees to maintain the terms and conditions of the MOU, including strict security over the access and use of information from DDES.  All changes, modifications, or amendments to the MOU must be in the form of a written amendment executed by both parties.
This matter was reviewed by Deputy City Attorney Kendra Carney on October 8, 2014, and Budget Management Officer Victoria Bell on October 9, 2014.  
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on November 11, 2014, to address ongoing criminal investigations.
 
FISCAL IMPACT
There is no cost to the City for this MOU.  Criminal investigation activities are budgeted in the General Fund (GF) in the Police Department (PD).  There is no local job impact associated with this recommendation.
