DISCUSSION
Following the Lorna Prieta earthquake in October 1989, emergency legislation known as Senate Bill 36X was enacted. The law requires that all existing publicly-owned bridges in California be inspected and those found to have a seismic structural deficiency be upgraded and retrofitted to conform with specific structural standards. The bill further provides for the County of Los Angeles (County) to be the lead agency for inspecting and retrofitting all non-state highway bridges within the County.

To accomplish this, whenever a bridge is to be retrofitted by the County, a temporary transfer of jurisdiction to the County is required. In 2002, the City Council adopted a resolution consenting to the establishment of Artesia Boulevard over the Los Angeles River as a part of the system of highways of the County of Los Angeles. Jurisdiction will be returned to the City when the project is complete.

During research for the planned bridge seismic retrofit project at the Artesia Boulevard bridge over the Los Angeles River, it was found that portions of the existing bridge lie outside of the existing right-of-way. In order to proceed with the seismic work, additional right-of-way needed to be acquired. The County proceeded to appraise, make offers, and through action by the Board of Supervisors, the County formally acquired the additional right-of-way in July 2008. In order to reimburse the County for these expenses, and for the seismic retrofit project to proceed, the County is requesting that a formal acquisition agreement be executed between the City and the County.
