TITLE

Recommendation to authorize City Manager to execute an Assignment Consent Agreement for Facility/Pipeline Permit No. MW-85-00 from E. S. Bills, Inc. to Circle K Stores, Inc., in accordance with Section 15.44.220 of the Long Beach Municipal Code.  (District 5)

 

DISCUSSION

E. S. Bills, Inc., is requesting consent to assign its interest in Facility/Pipeline Permit No. MW-85-00 to Circle K Stores, Inc. (Circle K).  The permit is for a single groundwater monitoring well located on the east sidewalk of Cherry Avenue just north of Wardlow Road (Attachment). The well will be used to monitor possible hydrocarbon leaks from the underground storage tanks of a former gas station that was located on the northwest corner of Cherry Avenue and Wardlow Road. 

 

Since this is only a transfer of ownership with no use modifications, there will be no street excavations required for this action.  Long Beach Municipal Code Section 15.44.220, Permit-Transfer, requires the assignee, Circle K, to provide the City with an insurance policy and a performance bond for the permit.  Their insurance and bonding for the permit have been approved and are on file. 

 

This matter was reviewed by Deputy City Attorney Amy R. Webber on March 31, 2016, and by Budget Management Officer Victoria Bell on April 7, 2016.

 

TIMING CONSIDERATIONS

City Council action is requested on May 3, 2016, to execute the Assignment Consent Agreement in a timely manner and formalize the transfer of ownership.

 

FISCAL IMPACT

There is no fiscal or local job impact associated with this recommendation.
