TITLE

Recommendation to authorize City Manager, or designee, to execute an amendment to Operating Agreement 29297 with the Long Beach Public Transportation Company, for public transportation services, for a seven-year term, beginning July 1, 2014 through June 30, 2021.  (Citywide)

 

DISCUSSION

On August 2, 2005, the City Council adopted a nine-year operating agreement with Long Beach Transit to provide transportation in the city of Long Beach and surrounding communities.  That agreement expired on June 30, 2014, and a seven-year agreement is being brought forward for City Council approval.

 

Over the years, the City has entered into ten-year agreements with Long Beach Transit. This request will continue the operating relationship between the City and Long Beach Transit.  Since the previous agreement, Risk Management staff is recommending a change in the protection and indemnity (P&I) insurance from “One Million Dollars ($1,000,000) per occurrence” to “Five Million Dollars ($5,000,000) per occurrence.”  All other terms of the existing agreement are proposed to continue. The City has a separate funding agreement with Long Beach Transit using Proposition A Local Return Program funds to reimburse for operational needs and Police Department services.

 

This matter was reviewed by Deputy City Attorney Amy R. Webber on September 6, 2016 and by Revenue Management Officer Julissa José-Murray on September 15, 2016.

 

TIMING CONSIDERATIONS

City Council action on this matter is requested on October 4, 2016, to authorize the timely execution of the seven-year operating agreement.

 

FISCAL IMPACT

There is no fiscal impact associated with this item, as this agreement only addresses the operating relationship.  There is no local job impact associated with this recommendation
