TITLE

Recommendation to authorize City Manager, or designee, to execute a Public Walkways Occupancy Permit for sidewalk dining at The Ordinarie, located at 210 The Promenade North.  (District 2)

DISCUSSION

The operator of The Ordinarie, located at 210 The Promenade North, requests a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining. The proposed permit area and the list of furnishings and accessories to be placed in the permit area are shown on Exhibit A. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public right-of-way.

The proposed permit area will be located adjacent to the restaurant along the east side of the 80-foot wide The Promenade, consisting of a ground-supported trellis structure, with fixed steel rafters, tables, chairs, heaters, and a low barricade.  A central clear path greater than 20 feet will be maintained within the remaining right-of-way, adjacent to the permit area.

This matter was reviewed by the Department of Development Services Building and Safety Bureau on March 16, 2018, by Deputy City Attorney Linda T. Vu on February 23, 2018, and by Budget Analysis Officer Julissa José-Murray on March 6, 2018.

TIMING CONSIDERATIONS

City Council action on this matter is not time critical.

FISCAL IMPACT

A permit processing fee of $1,714 was deposited in the General Fund (GF) in the Public Works Department (PW), and a security deposit of $1,820 was collected to ensure sidewalk repairs upon permit termination.  Approval of this recommendation will provide continued support to the local economy.
