TITLE

Recommendation to authorize City Manager, or designee, to execute a Property Damage Release from State Farm General Insurance Company and accept a settlement of damage claim in the amount of $3,409.40 to be deposited in the Health Fund

(SR 130 in the Department of Health and Human Services (HE)).  (Citywide) 

 

DISCUSSION

The Long Beach Department of Health and Human Services Environmental Health Bureau, Hazardous Materials Emergency Response Team (Health HazMat) routinely responds to and oversees the clean-up of chemical spills impacting the public’s safety. 

 

On December 17, 2014, a paint spill occurred at 122 E. 21st Street, which discharged off of the property and impacted the street and storm drain system in the surrounding area.  Health HazMat responded to assess the spill and contacted the City’s environmental contractor, Ocean Blue, to clean up the spill.  The property owner was subsequently billed $3,409.40 for the clean-up costs, and the property owner’s insurance company, State Farm, has agreed to settle the bill (Claim No. 75-38V4-884), and is requesting a signed property damage release form prior to submitting the settlement check.  The release represents the full and final settlement for all costs associated with the spill.

 

This matter was reviewed by Deputy City Attorney Linda Vu on July 14, 2015 and by Budget Manager Lea Eriksen on July 15, 2015.

 

TIMING CONSIDERATIONS

City Council action on this item is not time critical.

 

FISCAL IMPACT

The City will be reimbursed $3,409.40 for the costs associated with the clean-up of this spill.  This amount represents full and final settlement of this claim which will be deposited in the Health Fund (SR 130) in the DHHS (HE).  There is no local job impact associated with this action.

Approve recommendation.
