TITLE
Recommendation to authorize City Manager to execute a right-of-entry permit for Manson Construction Company to access the Catalina Landing Marina, located at 310-340 Golden Shore Street, to provide dredging services commencing March 5, 2010. (District 2)
DISCUSSION
City Council approval is requested to execute a right-of-way permit to allow the dredging of the Catalina Landing Marina (Marina). On November 3, 2009, City Council authorized the City Manager to contract with Manson Construction Company to provide dredging services at the Marina. The City of Long Beach (City) is the trust grantee for the State of California for this property.
Manson Construction Company has signed the contractual agreement and is scheduled to begin the 41-day dredging project on March 5, 2010. It is anticipated that during this time, access to the marina will be closed. The City has been working with the current lessee, the Abbey Company, and their tenant, Catalina Express, to minimize closure dates.
The proposed right-of-entry permit contains the following major provisions:
· Authorized Use: Access City-owned property known as the Catalina Landing Marina, located at 310-340 Golden Shore Street, for the sole purpose of removing docks and piles, along with dredging and removal of an estimated 50,000 cubic yards of sediment.
· Term: 41 days, commencing on March 5, 2010.
· Fees: No fees will be charged for the permit, since it is the City's responsibility to maintain the depth of the marina.
· Insurance: The right-of-entry permit will require Manson Construction Company to indemnify the City and provide insurance as required by the City's Risk Manager.
This matter was reviewed by Deputy City Attorney Gary J. Anderson on February 11, 2010, and Budget Management Officer Victoria Bell on February 11, 2010.
TIMING CONSIDERATIONS
City Council action is requested on March 2, 2010, to enable the prompt execution of the right-of-entry permit.
