TITLE
Recommendation to authorize City Attorney to pay sum of $15,000 in full settlement of lawsuit entitled Chase Herrera v. City of Long Beach, et al.; $40,000 in full settlement of the lawsuit entitled Pineda-Stites v. City of Long Beach and Hurley Owens, Case No. BC477873; and $13,500 in full and final resolution of the lawsuit entitled Robert Taylor v. City of Long Beach.

DISCUSSION
On September 17, 2012, Long Beach Police officers were dispatched to 355 Obispo Avenue regarding a neighbor dispute call. Officers contacted plaintiff at the location as part of their investigation, and there was a use-of-force incident. Plaintiff alleges that his civil rights were violated; the City and the officers deny any liability.

This matter was discussed at the Economic Development and Finance Committee on December 19, 2014 and approved. Based thereon, we respectfully recommend that you approve the settlement.


Plaintiff, a clerk typist III, with 5 years of service with the City, filed suit against the City and her supervisor following her termination alleging discrimination (Plaintiff is Hispanic) and harassment. After a mediation with a retired judge, Plaintiff agreed to accept $40,000 as full settlement, inclusive of attorney’s fees and costs.

A presentation was made to the Economic Development and Finance Committee on December 19, 2014, at which time the Committee voted to approve settlement of the above-referenced matter.

Plaintiff, Robert Taylor was employed by the City of Long Beach as a supervisor in the Marine Maintenance Division of the Department of Parks, Recreation and Marine From 1999, until October of 2011. The plaintiff alleges that he was discriminated against and harassed on account of his race and age.
A presentation was made to the Economic Development and Finance Committee on December 19, 2014, at which time the Committee voted to approve settlement of the above referenced matter.
