TITLE
Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit for sidewalk dining at the Beachwood BBQ and Brewing at 210 East Third Street. (District 2)
DISCUSSION
The developer of a new restaurant that will be known as the Beachwood BBQ and Brewing requests a permit to temporarily occupy a portion of The Promenade for the purpose of sidewalk dining. The Promenade area they wish to occupy in this pedestrian-only right-of-way was designed for the purpose of restaurant occupancy. Because this area is located on a west-facing facade with a large expanse of window wall, a fixed sun-screen awning is proposed. The proposed permit area and a list of furnishings and accessories to be placed in the permit area are shown on the attached Exhibit A. An exhibit showing the awning is attached as Exhibit B. A permit for the construction of the canopy must be obtained from the Department of Development Services.
Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public rights-of-way. The Promenade has a total width of 80 feet at this location. A central walkway and clear emergency access path, greater than 20 feet, will be maintained beyond the permit area. Deputy City Attorney Linda Trang prepared the subject permit on April 27, 2011. The Long Beach Fire Department's review and approval of this request shall be obtained prior to permit issuance.

TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
FISCAL IMPACT
A permit-processing fee of $2,507 was deposited into the General Fund (GP 100) in the Department of Public Works (PW). A matching security deposit will be deposited prior to the issuance of the permit. There will be no local jobs impacted by this recommendation.
