TITLE
Recommendation to authorize City Attorney to accept an easement deed for the widening of the alley east of Chestnut Avenue and north of Third Street adjacent to 345 West Third Street.  (District 2)
 
DISCUSSION
It is the goal of the Department of Public Works to widen streets and alleys to the standards established in the City's General Plan. When significant new development is proposed, the public rights-of-way adjacent to the site are reviewed for sufficiency to accommodate the new  development. The First Congregational Church at 241 Cedar Avenue is constructing a parking lot across the street at 345 West Third Street. The dedication of additional alley width is recommended as follows:
 
The existing 10-foot wide alley adjoining the new parking lot should be widened by 5 feet, to a total width of 15 feet. The standard alley width of 20 feet will be achieved when property on the north side of the alley is improved and an additional 5 feet of alley width is dedicated. A map of the area to be dedicated is attached as Exhibit A.
 
The First Congregational Church agreed to development conditions that include the above-described dedication. This matter was reviewed by Deputy City Attorney Lisa Peskay Malmsten on December 20, 2005. In conformance with the California Environmental Quality Act, Categorical Exemption No. CE-214-04 was issued for this project.
 
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
 
FISCAL IMPACT
A document processing fee of $250 was paid by the developer and deposited in the General Fund (GP) in the Department of Public Works (PW).
 
SUGGESTED ACTION
Approve recommendation.
