TITLE
Recommendation to request City Manager to implement the attached Recommended Airport Policies and Actions. (District 5)
DISCUSSION
At the City Council meeting of July 11, 2006, the City Council voted to extend the statute of limitations resulting from the filing of the Notice of Determination for the Airport Terminal Improvement EIR for a period of approximately 90 days, terminating on October 24, 2006. In addition, the City Council directed the City Attorney and the City Manager to discuss and negotiate the proposed size of the Airport Terminal Project and any appropriate mitigation measures with a representative group of Airport EIR appellants. The desired outcome of these discussions was to reach an agreement that would avoid litigation on this matter. Progress was made and the filing period was extended to January 5, 2007, and then again to April 6, 2007. Unfortunately, several members of the appellant group proceeded to file suit over this matter on March 16, 2007. Due to this action, further negotiations on this matter have ceased.
During the negotiation period, many recommendations were made by the appellants' representatives that staff felt could be accommodated and would help alleviate community concerns regarding the proposed project. These recommendations, which could have been a part of the settlement agreement being negotiated, are attached as recommended Airport Policies and Actions.
This matter was reviewed by Assistant City Attorney Mike Mais on April 18, 2007.
TIMING CONSIDERATIONS
City Council approval is requested on April 24, 2007, to insure that these recommended Airport Policies and Actions are implemented in a timely manner.
FISCAL IMPACT
Fiscal impacts are unknown at this time.
