TITLE
Recommendation to authorize City Manager to execute a right-of-entry permit and any related documents with Long Beach Transit in association with the proposed project to upgrade a City dock in the Alamitos Bay Marina. (District 3)

DISCUSSION
Long Beach Transit (LBT) has used a portion of a City of Long Beach (City) commercial long dock in the Alamitos Bay Marina since 2001. This dock is used for the AquaLink service between downtown and Alamitos Bay. This long dock has never been adequate for the public AquaLink service because it is difficult to provide handicap accessibility from the dock. As a result, LBT approached the City with a request to move their operation to Berth 3, which is a commercial berth. This request is feasible and acceptable to the City.

Currently, LBT is moving forward with an upgrade to the dock in Berth 3, which will provide handicap accessibility for the AquaLink service. This upgrade will be wholly funded by LBT. In addition, LBT will be responsible for acquiring all necessary permits and approvals that may be required by the California Coastal Commission, the Department of Parks, Recreation and Marine (PRM), and the Department of Development Services.

This matter was reviewed by Deputy City Attorney Gary J. Anderson on May 9, 2013 and by Budget Management Officer Victoria Bell on May 10, 2013.

TIMING CONSIDERATIONS
City Council action is requested on June 4, 2013, in order to allow LBT to complete the permit process, design the upgrade to Berth 3 in Alamitos Bay Marina, and to commence the bid process and award the project.

FISCAL IMPACT
Long Beach Transit will solely fund the dock upgrade, and the project will have no cost to any City funds. The recommended action will result in a positive impact on jobs in the construction and trade industries. However, as PRM will have no control over the selection, contracting, and management of the contractors, it is unknown at this time how many jobs will be created.
