TITLE
Recommendation to authorize Department of Financial Management to process a refund in the amount of $14,742 to The Kind and the Compassionate Collective, located at 4103 E. Viking Way. (District 5)
DISCUSSION
On February 19, 2011, an amendment was added to the Long Beach Municipal Code (LBMC) section 5.87.040 (B) requiring medical marijuana collectives to be more than 1,000 feet away from public parks. The Kind and the Compassionate Collective was eliminated from the medical marijuana collective permit process as a result of this change in the ordinance; therefore, the applicant is eligible for a refund.
The LBMC section 3.48.040 requires refunds exceeding $10,000 be approved by the City Attorney and City Council. The Department of Financial Management, Business Relations Bureau, has reviewed the request for refund and recommends the refund be granted.
This matter was reviewed by Deputy City Attorney Kendra Karney on June 24, 2011 and by Budget Management Officer Victoria Bell on August 16, 2011.
TIMING CONSIDERATIONS
City Council action is being requested on September 6, 2011 to expedite processing of the refund.
FISCAL IMPACT
The amount of $14,742 will be refunded from the General Fund (GP) in the Department of Financial Management (FM). No known job impacts will result from this action.
SUGGESTED ACTION
Approve recommendation.
