TITLE
Recommendation to authorize City Attorney to pay sum of $525,000 in full settlement of lawsuit entitled Michael J. Gegeny v. City of Long Beach, Superior Court Case No. BC553047.
DISCUSSION
Plaintiff brings this action alleging that Long Beach Police officers used unreasonable force while arresting him. Plaintiff alleges he sustained injuries during the encounter, and alleges that the officers and the City are liable for his injuries and other damages. Following settlement discussions with a private mediator, plaintiff agreed to accept $525,000.00 - inclusive of attorneys' fees and costs - as a full, global settlement of this case. The City Attorney presented the proposed settlement to the Economic Development and Finance Committee on March 20, 2018, and the settlement was approved on that date.
