TITLE
Recommendation to adopt revised resolution to authorize City Manager to submit a grant application to the California Department of Parks and Recreation for the Habitat Conservation Fund Program for the West San Gabriel River Parkway project. (District 5)

DISCUSSION
On September 18, 2007 (attached), the City Council adopted Resolution RES-07 -0127 authorizing the City Manager to apply for grant funding for the West San Gabriel River Parkway Project for the restoration of habitat areas along the San Gabriel River with funding from the Habitat Conservation Fund Program (HCF).

Recently, the California Department of Parks and Recreation (DPR) reviewed all submitted grant applications for sufficiency. Upon review of the grant application and Resolution submitted by the City of Long Beach (City), a discrepancy was identified in the Resolution. The DPR has requested the City submit a revised Resolution to include the following provisions:

. "Section 4. Certifies that said Applicant shall prepare, with full public participation, a
management plan for lands that have been acquired with HCF funds, which plan shall
reasonably reduce possible conflicts with neighboring land use and landowners,
including agriculturists."

. "Section 7. Certifies that said Applicant agrees to comply with all applicable federal,
state and local laws, ordinances, rules, regulations and guidelines."

The revised Resolution, as prepared by the City Attorney's Office, is attached. Upon City Council approval, City staff will forward the revised Resolution to the DPR. It is expected that a representative from the DPR will contact the Department of Parks, Recreation and Marine for project site visits, with grant funding announced by June 2008.

Deputy City Attorney Gary Anderson reviewed this matter and prepared the attached Resolution on March 18, 2008, and Budget Management Officer Victoria Bell reviewed this matter on March 20, 2008.
