TITLE

Recommendation to authorize City Attorney to pay sum of $15,000 in full settlement of lawsuit entitled Marlo Hutchison vs. City of Long Beach.

DISCUSSION

Plaintiff, Marlo Hutchison was involved in an automobile accident which occurred on May 22, 2003, on 1^st Street between Elm Avenue and Long Beach Boulevard.  The Plaintiff was driving her vehicle on 1^st Street when she was struck on the side of her car by a City vehicle exiting from a parking structure onto 1^st Street.  Plaintiff was 7 months pregnant at the time of the accident.  The force of the impact caused her to strike her stomach on the steering wheel, resulting in her having contractions and staying overnight at Kaiser Hospital.

      During a court ordered Mandatory Settlement Conference, the parties tentatively agreed to a full and complete settlement, inclusive of all costs and fees in the amount of $15,000.00, with no admission or determination of liability.

      The proposed settlement was presented to the Economic Development and Finance Committee on June 7, 2005 and was approved on that date.  We therefore ask authority to pay the sum of $15,000.00 in full settlement of this claim against the City of Long Beach.
