TITLE
Recommendation to request City Manager or designee to accept an easement for public access, transit and utility purposes within City Place. (District 1)
DISCUSSION
In 2001, Tract Map No. 53306 subdivided the mixed-use redevelopment parcels known collectively as City Place. The map created an irrevocable offer to dedicate for future street purposes the areas shown as Fourth Street, Fifth Street and The Promenade North (bounded by Pine Avenue, Long Beach Boulevard, and Third Street). A reduced copy of the tract map showing the areas to be accepted as a public street easement is attached as Exhibit A.
It is recommended that an easement for public access, transit and utility purposes now be accepted over the areas shown as future public streets on the map. Because the property owner has installed commercial signage and other private structures and fixtures, it is not appropriate to accept a public street dedication.
This matter was reviewed by Deputy City Attorney Amy R. Burton on April 30, 2008, and Budget Management Officer Victoria Bell on May 14, 2008. In conformance with the California Environmental Quality Act, Categorical Exemption No. CEP 61-08 was certified for this project.
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
