TITLE
Recommendation to authorize City Manager to execute the First Amendment to Lease No. 30190 with the Association for Retarded Citizens - Long Beach, Inc., a California nonprofit corporation, to revise the authorized use section of the Lease to allow the Long Beach Little League, Inc., access to the 45 parking spaces in the rear parking lot adjacent to Stearns Champions Park during the baseball season. DISCUSSION
The Association for Retarded Citizens - Long Beach, Inc., (ARC) has leased Cityowned property at 4519 E. Stearns Street, since 1954. ARC serves the Greater Long Beach area, operating programs for adults with developmental disabilities. ARC receives funding from the State Department of Rehabilitation and the Department of Developmental Services. On April 17, 2007, City Council authorized the execution of Lease No. 30190 (Lease) for a five-year term, through December 31,2011, with two five-year renewal options.
Shortly after the execution of the Lease, Long Beach Little League, Inc. (League), requested authorization to use the rear parking lot adjacent to Stearns Champions Park during the baseball season. The Department of Parks, Recreation and Marine has been working with ARC and League representatives to ensure a safe and mutually amicable use of the property.
The proposed First Amendment contains the following revisions, which all parties have agreed to:
· Authorized Use: The premises shall be used for the operation and maintenance of a facility providing training for mentally retarded persons and uses connected therewith, with the exception of allowing Long Beach Little League, Inc., access to the 45 parking spaces in the rear parking lot for the purposes of parking only on the dates and times specified in the Lease.
· Insurance: Long Beach Little League, Inc., shall provide evidence of insurance as deemed sufficient by the City's Risk Manager and the Association for Retarded Citizens - Long Beach, Inc.
