TITLE

Recommendation to authorize City Attorney to submit claim for death benefits for approval by the Workers' Compensation Appeals Board, and if so approved, authority to pay $160,000 plus additional statutory benefits in compliance with the Appeals Board Order for decedent, David Nieto.

DISCUSSION

David Nieto, by and through his Widow, Lurline Nieto, and their children, Gabriel Michael Nieto, Nicholas Stephen Nieto, and Tyler Joseph have made a claim for death benefits allegedly caused by his employment with the City of Long Beach. The Economic Development and Finance Committee on June 12, 2007, approved the submission to the Workers' Compensation Appeals Board of Stipulations with Request for Award for death benefits by the City and David Nieto on behalf of his widow and dependents.

SUGGESTED ACTION

Approve recommendation.
