TITLE

Recommendation to receive supporting documentation into the record, conclude the public hearing, find that the area to be vacated is not needed for present or prospective public use, and adopt resolution ordering the vacation of the un-named alley opening adjacent to 400 East Willow Street.  (District 6)

 

DISCUSSION

The subject vacation pertains to the findings, evidence, facts, and conditions establishing that the un-named alley opening described in the Final Decree of Condemnation, Case No. C-2003, recorded January 30, 1930, and shown on Exhibit A to Resolution, is unnecessary for public access use. Proceedings for this vacation are being conducted in accordance with Chapter 3, General Vacation Procedure, of the Public Streets, Highways and Service Easements Vacation Law of the California Streets and Highways Code.  Findings must establish that the subject right-of-way is unnecessary for present or prospective public use.

 

This matter was reviewed by Deputy City Attorney Richard F. Anthony on August 25, 2016 and by Revenue Management Officer Julissa José-Murray on August 26, 2016. 

 

TIMING CONSIDERATIONS

On August 9, 2016, the City Council adopted Resolution No. RES-16-0072, declaring its intention to vacate the subject right-of-way, and set September 20, 2016, as the date for the public hearing.  A copy of the August 9, 2016 City Council letter is attached as Exhibit B to Resolution. 

 

FISCAL IMPACT

There is no fiscal or local job impact associated with this recommendation.
