Recommendation to authorize Department of Development Services to process a refund in the amount of $63,564 to the California State University Long Beach Research Foundation for the property located at 1745 West Pacific Coast Highway.

DISCUSSION

On December 18, 2012, the California State University Long Beach Research Foundation (Applicant) paid fees totaling $418,556 to cover expenses and fees related to an Environmental Impact Report (EIR) for a proposed retail center at 1745 W. Pacific Coast Highway. The Applicant has decided to pursue other opportunities and has withdrawn the application. To date, the Department of Development Services has drawn a total of $354,992 to reimburse expenses incurred in preparing the EIR. In accordance with Long Beach Municipal Code (LBMC) Section 3.48.030, the Applicant is eligible for a refund of $63,564, the remaining balance of the original deposit.

 

In accordance with LBMC, Section 3.48.040, which requires that refunds exceeding $10,000 be approved by the City Attorney and City Council, authorization to process the refund is requested on behalf of the Applicant.

 

This matter was reviewed by Deputy City Attorney Kendra Carney and by Budget Management Officer Victoria Bell on August 5, 2015.

 

TIMING CONSIDERATIONS

City Council action is requested on September 1, 2015, to expedite processing of the refund.

 

FISCAL IMPACT

The deposit has been held in trust; its return will not affect the funds available or the operating budget of the Department of Development Services. The amount of $63,564 will be refunded from the Development Services Fund (EF 337) in the Development Services Department (DV). There will be no local job impact as a result of the recommended action.
