TITLE

DISCUSSION
City Council approval is requested to execute a right-of-entry permit to allow the painting of murals along 660 linear feet of walls, located at Seaside Park. On April 10, 2010, the Arts Council for Long Beach entered into a contract with mural artist, Jose Loza. The Department of Parks, Recreation and Marine is the trust grantee for this property.

Jose Loza has signed the contractual agreement and is scheduled to begin the 90-day mural project in July 2010. The new soccer fields in this area have not yet been opened to the public, and will remain closed during this period in order to allow time for the grass to get fully established. This matter was brought before the Parks and Recreation Commission, who unanimously approved it at their May 20, 2010 meeting.

The proposed right-of-entry permit contains the following major provisions:

· Authorized Use: Access City-owned property known as Seaside Park, located at 1401 Chestnut Avenue, for the sole purpose of painting of murals along 660 linear feet of walls.

· Term: 90 days, commencing July 2010.

· Insurance: The right-of-entry permit will require Jose Loza to indemnify the City and provide insurance as required by the City's Risk Manager.

This matter was reviewed by Deputy City Attorney Gary J. Anderson and Budget Management Officer Victoria Bell on June 14,2010.

TIMING CONSIDERATIONS
City Council action is requested on July 6, 2010, to enable the prompt execution of the right-of-entry permit.

FISCAL IMPACT
There is no fiscal impact to the City associated with the recommended action. The recommended action will result in a positive impact on local jobs. Four local artists/painters will be hired to assist Mr. Loza for the duration of the projects.
